Accidents on a package tour holiday

The Package Travel, Package Holidays and Package Tour Regulations 1992 are very helpful for travellers. 

If your holiday meets the definition of a package tour and the injury was caused by something provided as part of that package, then you can claim against your tour operator in the British Courts. 

A classic example of a package holiday will be where you have travelled abroad on holiday with a well-known tour operator and paid all in for your flight, transfer to and from airport, accommodation and possibly also food.  It is important that at least two of these make up the pre-booked holiday. 

If you then suffer injury linked to these, then you would have a claim under the Package Tour Regulations. 

For example, the coach transferring you from the airport to your hotel might be involved in an accident.  You might fall over and the injured in a pothole in the grounds of your hotel.  Your hotel bed may be defective and collapse, causing injury. 

The case can be brought in the British Courts and you have to issue Court proceedings within 3 years of the injury.
