Case studies
Slipping accident in Spanish restaurant
This elderly client slipped in the restaurant in a Spanish hotel at breakfast time. It was alleged that water had leaked from tea urns onto the floor. This was a hard fought case with the Defendants flying in Spanish waiters at the last moment for the trial. Although there was no loss of income in this case - she was retired, she required a lot of care and assistance from her husband after her injuries. Taking this into account we were able to recover over £50,000 for this client when her claim was upheld by the Judge.
Gerona air crash
We acted for a number of claimants who were injured when flying from Cardiff to Gerona in 1999. Thankfully the physical injuries of many were minor but they were significantly traumatized by the experience but through a close examination of the booking conditions we were able to circumvent the confines of international air travel treaties that do not allow claims for psychological injuries. In these cases we were indeed able to recover for psychological injuries. Some clients received just a few thousand pounds but several of our clients were awarded sums in excess of £50,000 when it was demonstrated that their psychological trauma had resulted in significant loss of earnings.
Corfu carbon monoxide poisoning
Russell Jones & Walker are involved in the carbon monoxide incidents in Corfu in late 2006. Tragically young children were killed in this matter. This incident was the subject of a Panorama enquiry that was highly critical of the hotel involved. Our clients took part in the documentary.
Food poisoning in the Dominican Republic
Russell Jones & Walker are acting for a number of people involved in a number of high profile food poisoning incidents in the Dominican Republic. Most of these involve all inclusive package holiday hotels. Concern has been voiced about the standards of hygiene and food in such countries that are increasing in popularity, particularly with families.
Slipping at poolside accident
Mrs M - Russell Jones & Walker recently recovered over £5,000 for a client who slipped near the swimming pool at her resort in Tunisia. Her claim was brought through the Package Tour Regulations in the UK. The client suffered a broken wrist and missed a few months of work. It was proved that she slipped on a defective tile near the poolside. The client had good photographic evidence of the tile. She recovered over £5,000 from her tour operator.
Skiing accidents
Russell Jones & Walker have expertise in acting for people injured in skiing accidents abroad. With the assistance of our expert French ski lawyer, we have recently recovered compensation for Mr P from Cardiff who was crashed into by another skier whilst on holiday in France. We are also acting for a snowboarder similarly injured recently in the Swiss Alps.
