Russell Jones and Walker’s personal injury department is acknowledged as a leading force in the country focussing on the needs of trade union members. We have won some landmark victories for injured claimants including the cases of Parry v Cleaver, which protected the pensions of claimants forced to retire because of their injuries and Heil v Rankin which increased the level of damages in serious injury cases.
Last year Prospect members received nearly £4.5 million in accident compensation through the Union’s personal injury scheme. Most of this went to members injured in accidents at work, but we also recovered compensation for members suffering from stress at work, noise induced deafness, RSI, asbestos related conditions and hand arm vibration syndrome.
Prospect’s scheme also covers accidents outside the workplace, including car accidents. It even covers injury claims for family members (provided the accident was not at wok).
Retired members can also make use of the personal injury scheme. Many successful claims have been made for retired members exposed to asbestos during their working life.
Retired members will not be entitled to assistance for an injury that arises in the course of employment undertaken during their retired membership, however they would still be entitled to asistance in respect of non work related accidents or illness.
