
Criminal and misconduct matters

Russell Jones & Walker has provided the Police Federation of England & Wales and its members with legal advice and representation in criminal and disciplinary proceedings since police officers were first given the right to be legally represented in disciplinary proceedings by the Police And Criminal Evidence Act 1984.

Our experience
Our experience is unique and unrivalled. Examples of our successes include the following:-
1. Calveley & Merrill
Funded by the Police Federation we successfully challenged in the High Court the late service of Regulation 9 Notices, establishing the precedent that “as soon as practicable” means days rather than weeks.
2. The Guildford Four and Birmingham Six cases
We successfully defended members who were prosecuted in both these high profile alleged miscarriage of justice cases.
3. Death following police contact
We have advised and represented officers in the vast majority of post incident investigations into deaths in police custody. These include the high profile cases of Joy Gardner, Brian Douglas and Richard O’Brien. This has included successfully defending officers prosecuted for offences of manslaughter and malfeasance, and representing the interests of officers at coroner’s inquests.
4. We have advised officers in virtually every post incident investigation into a police shooting incident. In the high profile cases involving the shooting of James ASHLEY in Sussex, and the shooting of David EWAN in Barnes, we successfully represented officers prosecuted for murder. We have looked after the interests of officers involved in the Hackney Seige 2002/3, and the shooting of Derek BENNETT in Brixton.
5. In the BENNETT shooting case we successfully challenged the coroner’s refusal to grant the officers anonymity and ensured that the officers remained anonymous through out the proceedings.
In every case we provide a first class service irrespective of the sanction which the Officer may face. In all cases we aim to ensure the member receives the best possible result as swiftly as possible.

We provide a nationwide service to Federation members. We advise the Federation on proposed changes to legislation and terms and conditions which enables us to keep abreast of developments throughout the country.
