Expertise

Juliette acts for both institutional and private clients in all areas of employment law, with a particular interest in discrimination and class actions. 

Experience

Juliette represented the Claimants in the case of Blackburn and Manley v. The Chief Constable of West Midlands Police. In October 2006 officers Manley and Blackburn won a three-year battle against WMP in what was believed to be the first successful equal pay case against the Police in 37 years of the legislation being enacted.  The Employment Tribunal found that the two police officers had been indirectly discriminated against on grounds of sex when they were denied Special Priority Payments (additional payments to officers who performed more demanding roles), as they were temporarily excused from working at night because of childcare responsibilities.  The Chief Constable appealed this decision to the Employment Appeal Tribunal in 2007, and the case is now the subject of an appeal to the Court of Appeal.  The appeal is due to be heard by the Court of Appeal in July 2008.

Juliette successfully represented the Appellant in the EAT case of Dattani v. The Chief Constable of West Mercia Police, which considered the extent to which Tribunals should draw inferences from evasive conduct on the part of the employer.  This decision widened the ambit of the Tribunal's discretion to draw inferences.

Juliette  also  successfully represented the Respondent in the reported EAT case of Gloystarne Ltd v. Martin, a case addressing the issue as to whether a representative, in this case a Trade Union official, could authorise a settlement on a Claimant’s/member’s behalf.

Her other notable cases include advising a Trade Union as to the legality of the installation of CCTV cameras in workplace restrooms and private areas.  This case involved advice on referrals to the Information Commissioner (established by the Data Protection Act 1998), and was featured on a BBC Wales current affairs television programme. 

Career

Juliette has worked for Russell Jones & Walker since August 2001.

Education

Juliette studied law at university in Nottingham, graduating in 1995, followed by the Legal Practice Course at Nottingham Law School. Juliette qualified in March 1999, and initially practised in the Midlands, before moving to Cardiff in June 2000.

Publications

Juliette has presented numerous seminars and has written a number of articles on a variety of employment law issues, including discrimination, regionalised pay, and whistleblowing.

Professional Memberships

She is a member of the Employment Lawyers’ Association.  Juliette is also a member of the Cardiff and Vale NHS Trust's Maternity Users Group.  The Group meets bi-monthly to discuss issues relevant to the care of pregnant women and new mothers.  Juliette was invited to join following the birth of her son in September 2005, and in light of her discrimination law background.
