Defamation (libel and slander)

This is when someone says, writes, broadcasts or communicates in another way something that makes people think badly of you or your business, damaging your reputation and feelings.

There are two types of defamation: Libel and Slander. Libel involves a “permanent” publication ie, something written,  broadcast on the TV, Radio or on a Website. Slander involves the spoken word or gestures or a publication that is not permanent.  Even if you have not been named or photographed in the publication you may have a claim if you can prove that the words referred to you.

You only have one year from the date of the publication to bring a claim unless the Court accepts there were exceptional reasons for not doing so.

Malicious falsehood

The deliberate and malicious publication of a false statement can cause serious financial damage to an individual, his or her property or business. A claim can be brought to secure financial compensation.
