Health & Safety and Corporate Manslaughter
The Corporate Manslaughter and Corporate Homicide Act received royal assent on 26th July 2007, finally fulfilling the Government's 10-year long promise to introduce this legislation. The driving force behind this legislation was the desire to better protect employees and members of the public when management failures on the part of large corporations lead to death.
We were involved in responding to the Government's proposals during the consultation process and have lectured and published extensively on the proposals, which will come into force in April 2008. The new provisions will mean that it will be easier to bring successful prosecutions of companies whose gross management failings lead to the death of an employee or a member of the public to whom a duty of care is owed.
We have a long history of representing clients in this area - in transport, construction, manufacturing, energy and health care, the police and military sectors - and most recently in representing a client following the Hatfield derailment.
