Inquests and fatal accident claims

Russell Jones & Walker Solicitors have many years experience in dealing with inquests. We are fully up to date with the case law in this rapidly developing area. The Human Rights Act has had a major impact on how deaths, especially deaths in a hospital or NHS care home, are dealt with.

We appreciate that this can be a terrible time for families and we ensure that they receive the maximum support and information to prepare them for the inquest.  In some cases the inquest will be the only occasion in which the family gets to ask the questions they want to be answered. We can use information obtained at the Inquest to help with a compensation claim.

The Coroners’ court is not a civil court and there are limits on what can be achieved. In particular, the Coroners’ rules prevent them from blaming specific individuals for a death and witnesses are not required to answer questions that may incriminate them. Also, the Coroner is only conducting an Inquest to find out who, where, when and how a person died.

We are familiar with what can be achieved in an Inquest and the limitations of the process. We will ensure that the hearing is fair and that the family is able to find out as much as the process allows.
