Claims against GPs often involve allegations relating to a failure to diagnose or refer to an appropriate hospital specialist. The responsibility of the GP is to act as a gatekeeper and ensure that hospital resources are used in an appropriate way.

Strict protocols are beginning to be put in place by NICE (the National Institute for Clinical Excellence), especially about making appropriate referrals. GPs are required to follow these protocols and make the appropriate referral once a patient has shown certain symptoms. A failure to follow these guidelines can be evidence of a GPs negligent treatment.
