Frequently asked questions

1) Can I only claim if the accident wasn’t my fault?

  • It is possibly to succeed in a PI claim even if you are partly at fault. Ultimately though someone else must have caused – be to blame – for your injury.

2) How soon do I need to place a claim once I return from holiday?

  • You should put a claim in as soon as possible. Report it at the time start your claim as soon as you are at home. Some holiday insurance policies require notification within a short specific period (e.g. 30 days)

3) What if I need to claim for my accident or illness from the country where it happened?

  • In some foreign countries there can be a short time period by  which you have to start proceedings if you must run your claim in that foreign jurisdiction. In Spain it is only one year. The safest course of action is to seek expert legal advice as soon as possible.

4) What sort of funding options do you offer to help pay for the legal costs of my claim?

  • RJW offer no win no fee arrangements for cases we consider to have reasonable prospects of success. Alternatively we may be able to ask through legal expense insurance you have with your holiday insurance or even other insurance policies you have. Under either of these two methods there should be no costs to you. Call free for initial advice.

5) My accident happened when I was in a non EU country, can I still claim?

  • There are some procedural advantages if your accident happened in the EU but generally it makes little difference as to what country you were in.

6) Can I still claim if I booked the holiday myself and didn’t go through an agent or tour operator?

  • Yes you can still claim against whoever caused the accident  - the claim may have to be brought in the country where the accident happened.

7) What if the excursion or activity was not booked through a tour operator?

  • You will probably have to claim against the excursion company direct which means you will need to bring the claim in the country where the accident happened. RJW has a network of  specialist lawyers across the globe who are used to acting for British residents injured abroad.

8) Should I claim through my travel insurance or the tour operator/hotel direct?

  • You should check your travel insurance. You may find it dopes not cover certain types of accidents. It may not allow you to claim against your tour/package holiday company.

9) What industry accreditations should I be looking out for when booking my holiday?

  • Check the company is ABTA bonded, check that it is a registered company in the UK. Obtain and keep the companies brochure relating to your holiday. Check the small print in it.
