Sofa Rash Claims update
28 July 2008
After months of investigation, the cause of the skin rashes experienced by consumers who purchased sofas from Argos, Walmsley and Land of Leather, has been confirmed.
The cause of the skin rashes has been identified as the chemical Dimethyl Fumarate, a fungicide contained in a sachet inside the sofas, inserted to prevent mould during shipping. Crystals contained in these sachets transform into toxic gas, particularly when exposed to heat. This can then pass through clothes, causing the rash. It can take weeks or months to react to the chemical. There is also evidence to suggest that the gas may spread throughout the home.
A number of leather sofas , manufactured in China by Linkwise and largely purchased from Argos, Land of Leather and Walmsley’s, are affected. Over 1500 people have reported suffering symptoms, which include severe rashes and blistering, with some requiring hospitalisation. These symptoms, which may last months or years, have also been linked to two fatalities.
Led by partner, Richard Langton, Russell Jones and Walker is representing claims on behalf of 1300 people who have been affected. A group litigation order has also been granted for the claim - the largest ever action against a consumer good in the UK. It is estimated that £6-10 million could be owed in compensation if the claims are successful.
Most sofas have now been recalled, but if you are in doubt, affected batch numbers can be checked here.
If you think you may have experienced a rash caused by Dimethyl Fumarate, you can request a patch sensitivity test from your doctor. For advice on your legal rights if you have an affected sofa, don’t hesitate to contact Russell Jones and Walker – enquiries@rjw.co.uk or call 0800 884 0324.
