Man Scarred After Being Struck On Head By Digger Bucket
03 October 2006
Employers Admit Liability in Incident
A man who was hit on the head by a digger bucket at a farm is suing his employer for compensation after the injury left a scar on his head.
Mr Liam Diggins, 21, from Eggborough, between Selby and Pontefract, was working as a potato packer at the farm of MH Poskitt Ltd, in North Yorkshire, when he was asked to help install fences.
Liam Diggins says: “I was holding the posts while my boss used the digger to knock them in. The huge bucket swung round and hit me directly on the head, and blood gushed out.
”I was rushed to hospital and treated for a serious wound to the head.”
Sara Heppenstall, from national law firm Russell Jones & Walker, represents Mr Diggins. She says:
“This injury occurred because Mr Diggins’ foreman chose to use a mechanical digger to knock the fence posts into the ground, rather than dig holes for them as would be the normal technique.
“This was in breach of the Workplace Regulations.
“Mr Diggins’ employers have admitted liability in this accident and we are now seeking compensation to cover lost income having to take time off work, as well as the pain and suffering he has endured.”
