In criminal and misconduct cases difficult decisions have to be made in consultation with the member and friend as to whether or not the member should answer questions when interviewed under caution. The decision whether or not to answer questions in interview, or to put forward a written response, is a difficult one and the member is often under pressure to provide an account.
Cover for Federation members
In Criminal & Misconduct matters, the Federation provides cover for members requiring:
Legal advice:
- at all stages of criminal or misconduct investigations at no cost to the member provided it arises from or relates to police duty
- in all other misconduct hearings for member facing charges or a friend representing the member
Legal representation:
- in any criminal proceedings arising from or relating to police duty at no cost to member (with some conditions)
- in any misconduct hearing (and in appropriate cases appeals to the Police Appeals Tribunal) in which member denies the offence and where the ultimate sanction of dismissal is available
