Experts in TUPE - Transfer of Undertakings (Protection of Employment) Regulations
Your employment might transfer to a new employer in a number of different situations. For example it might sell its business to another owner; there might be a merger of business; or your employment might be contracted out or change to another contractor.
In many cases TUPE transfers involve change and uncertainty in the workplace, with the possibility of redundancy arising. Often sufficient information is not provided to employees about the consequences of the transfer. Employers also often indicate before or after the transfer that they intend to “harmonise” terms and conditions with those of the new employer. The implications of this and your rights in such situations can frequently be unclear.
TUPE and your rights
You may be wondering what your rights are in respect to TUPE transfers or if the “harmonisation” means giving up favourable terms and conditions. TUPE is a complicated area of employment law and it is recommended that you take legal advice if you lack confidence that your rights are being properly looked after.
At Russell Jones & Walker we have experts in TUPE who can advise you fully on your rights when your employment is transferred and assist you to enforce those rights, including through an employment tribunal if necessary.
