Client refused statutory redundancy payment runs own tribunal hearing

25 August 2011

Our client was refused a statutory redundancy payment on the basis she had refused suitable alternative employment in refusing either a transfer from Cardiff to Bridgend or the option of home working.

The tribunal accepted that neither option was suitable for the client in the circumstances. She did not have a car and was not a motorway driver. She also did not have the space at home to accommodate home working. The employer had also never assessed her home working conditions.

The client ran the case herself with us providing limited advice in the background given the limited amount at stake. The employer offered her 50% of her claim and we advised her to reject it and run the tribunal hearing herself which she did, everyone was pleased with the result.
