The Act consolidated and simplified the old law and provides that fraud can be committed by misrepresentation, a failure to disclose information or abuse of position. The Serious Fraud Office, Police and more recently the Financial Services Authority have all brought significant prosecutions using this Act in response to alleged fraudulent acts occurring in many different sectors.
