As there is an element of delay between sustaining a serious injury and receiving financial compensation, where possible we will request interim payments to ease the financial burden and to enable imeediate costs to be met.

Interim payments can allow you to receive a part of a settlement before a final judgement is reached on your case. This is only available where liability has been admitted by the other side, but it can be an excellent way to pay the immediate costs that can arise when you have suffered a serious illness or injury.

How does it work?

You can only ask for an interim payment if the defendant admits that they were responsible for the accident which caused your injuries.  The court can also order an interim payment to be made if certain criteria are met after the case has started. These payments can be made throughout the course of your claim.

How much can I claim and how often?

The amount of interim payment you receive will depend on your case, of course, but it will not be more than ‘a reasonable proportion’ of the likely overall award of damages.  There is no restriction on the number of applications for an interim payment you can make – but the total must be within the ‘reasonable proportion’ rule.

What can the money be spent on?

Interim payments are commonly spent on items such as private medical treatment, specialist aids and equipment, adapted accommodation, loss of earnings and the setting up of a care regime.  They help in maximising your recovery and improving your quality of life.

How does this affect my final award of compensation?

When your final award of compensation is made, the interim payments will be have been deducted from it.
