Judgement goes in favour of cerebral palsy sufferer claiming clinical negligence

A man who is suing a hospital over mistakes which were allegedly made during his birth is one step closer to succeeding in his claims.

The Court of Appeal has decided that the case involving Julius Whiston should proceed.

In 1974, he was delivered at London's Queen Charlotte's Hospital.

His legal team argue that he was starved of oxygen during his delivery and this was the cause of his cerebral palsy - a condition that affects movement and coordination.

It is alleged that a junior doctor spent more than half-an-hour trying to deliver him with forceps.

While his condition was described as "stable" when he was attending school and university, it has since declined and he now has to use a wheelchair constantly when he is away from home.

In addition, his speech has deteriorated and he has trouble swallowing.

Mr Whiston is seeking money to cover the costs of his care for the rest of his life.
